South Australia Implements Nation-Leading Penalties for Illicit Tobacco and Vape Sales

New Laws Crack Down on Illegal Tobacco and Vapes in South Australia

Starting today (28 November), South Australia will enforce some of the strictest penalties in the country against the sale of illicit tobacco and vapes. The Malinauskas Government has introduced measures aimed at dismantling criminal networks profiting from these illegal activities.

Under the new laws, penalties include:

  • Advertising Tobacco Products: Fines rise to $750,000 for the first offence and $1.1 million for subsequent offences.
  • Selling Without a License: Fines increase to $750,000 for a first offence and $1.1 million for repeat violations.
  • Sales to Minors: First offences now incur up to $1 million in penalties, escalating to $1.5 million for further offences.
  • Illicit Tobacco Sales or Possession for Sale: Fines climb to $750,000 for an initial breach and $1.1 million for repeated offences.
  • E-Cigarettes and Prohibited Products: First offences attract fines up to $750,000, increasing to $1.1 million for subsequent offences.

These penalties coincide with SAPOL’s Operation Eclipse, targeting criminal groups involved in the illicit tobacco trade and linked arson attacks. The $16 million taskforce launched in July by Consumer and Business Services has already seized nearly $12 million worth of illegal tobacco and vapes.

The government, alongside law enforcement and agencies like Victoria Police and Border Force, continues to combat these operations, reinforcing its commitment to public health and safety.
