Overview of ICC Decisions on Israel’s Challenges
The International Criminal Court (ICC) rejected challenges from Israel regarding its jurisdiction in the Situation in the State of Palestine. On 21 November 2024, the ICC’s Pre-Trial Chamber I dismissed Israel’s arguments under articles 18 and 19 of the Rome Statute.
Israel had contested the Court’s jurisdiction and requested a halt to proceedings, including investigations related to arrest warrants for Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant.
The ICC determined that Palestine’s territorial jurisdiction enabled the Court to proceed. It ruled that Israel’s acceptance was not required under the Rome Statute. Israel’s failure to seek a deferral of investigations when notified in 2021 further weakened its challenge.
Arrest Warrants Issued
Warrants for Netanyahu and Gallant were issued for crimes against humanity and war crimes, including starvation, persecution, and intentional attacks on civilians in Gaza. From October 2023 to May 2024, the leaders allegedly restricted essential supplies, worsening humanitarian conditions. Acts like denying medical aid and targeting civilians were deemed violations of international law.
While the warrants remain classified for safety reasons, key details were disclosed to inform victims and the public. The ICC continues to investigate the alleged crimes within its jurisdiction.
